Conditions of Sale

1. General

The following terms and conditions and any other related rules adopted by the Fondation Cartier and made available as provided herein (collectively the “Conditions of Sale”) shall apply to all sales of Cartier products that you (the “Customer” or “you”) may order from Cartier SNC, a general partnership registered with the Paris Commercial Register of Companies under the number B331 876 284, having its headquarters at 261 boulevard Raspail, Paris, 75014 (“the Fondation Cartier” or referred to herein as “us” or “our”) on the Internet via the Fondation Cartier Website, identified by the domain name www.fondation.cartier.com.

These Conditions of Sale apply only to sales made on the Website. The Fondation Cartier may modify its Conditions of Sale if necessary, at its sole discretion.

The Conditions of Sale applicable to any order placed on the Website are those in force at the time you place your order on the Website. When you check the “I accept” box at the order confirmation section of the Website before placing your order with the Fondation Cartier, you indicate your acceptance of these Conditions of Sale. If you refuse to accept these Conditions of Sale, you will not be able to order products from the Fondation Cartier Website.

Persons wishing to use the Website will also be deemed, by virtue of such use, to have agreed to be bound by our Website Terms of Use and our Privacy Policy, which are incorporated into these Conditions of Sale by reference.

2. Purchasing Eligibility

Only individuals (and not legal entities) who (a) have reached the age of majority (eighteen in most countries) and (b) have legal capacity to enter into contracts may order products on the Website (Please consult the payment and shipping policies below for more details). If you are under the age of majority or otherwise cannot lawfully enter into a contract, you must have your parent or guardian place an order on your behalf and thereby assent to these Conditions of Sale. Any orders placed in contravention to this provision shall be null and void.

The Fondation Cartier may refuse your order if the Fondation Cartier believes, at its sole discretion, that an order would violate these Conditions of Sale.

3. Product Availability; Quantity

All orders placed on the Website are subject to availability and acceptance by the Fondation Cartier. The Fondation Cartier reserves the right to change the assortment of items proposed on the Website and may limit from time to time the quantity of products that may be ordered by a Customer in a single buying session.

4. Account Registration; Personal Information; Guest checkout

In order to place an order on the Website, you register and create an online account. In order to register an online account, you will be required to provide valid and up-to-date information, such as your legal name, phone number and email address, and confirm that you have reached the age of majority.

Upon completion of your account registration on the Website, you will receive by email a one-time password, which will allow you to log in to your account on the Website and create a permanent account login and password. You may also receive a second email summarizing the personal information you provided in registering for your online account. You are responsible for ensuring that your password and account login are kept secret, safe and secure at all times. The Fondation Cartier will not be held responsible or liable for any misuse of your account resulting from a third party’s access to and use of your password and account login.

We may change the information required to place an order or the registration requirements from time to time. Any changes will be posted on the Website. Please refer to our Privacy Policy and Clause 8 of these Conditions of Sale for more details about how we may use your personal information.

Should any of the information you provide on the Website change, please log in to your account and update such information directly on the Website. Moreover, in the event that the Fondation Cartier reasonably suspects that a third party has breached a customer’s registration, password and/or account login, the Fondation Cartier shall immediately cancel and terminate such account, and notify you by email or telephone.

5. Orders

If you are ordering on the Website, orders will be processed as follows: Once you have chosen a product, click on the “Add to Shopping Bag” button to place this product in your shopping bag. You may then decide to continue shopping for other products and add them to your shopping bag (subject to availability and quantity limits) or proceed to “Checkout” by clicking on this button. You may also remove one or more products you selected from the shopping bag.

6. Prices, Tax and Shipping Costs

All prices shown on the product pages of the Website are in euros, VAT included, excluding shipping costs and all other taxes. Please note that French VAT is applicable regardless of where the products are shipped.

The Fondation Cartier reserves the right to modify prices and shipping costs at any time without prior notice. The price of a product and shipping costs displayed on the Website at the time the Fondation Cartier provides you with an order confirmation will be honored by the Fondation Cartier.

The shipping costs are not stated on the product pages but will be added to the product price after you have chosen your shipping options. Shipping costs will be reflected on your order page before you are asked to confirm and place your order with the Fondation Cartier.

Shipping costs, if any, are described in the shipping policy set forth below.

Please note that changes to applicable law between the date your order is placed with the Fondation Cartier and the date in which the Fondation Cartier is ready to ship your order may result in changes to the sales tax associated with your purchase, in which case we will contact you and ask that you reconfirm your purchase. If you do not reconfirm, the Fondation Cartier will cancel the order and notify you of this cancellation.

7. Review and Confirmation

You should carefully check all details before placing your order on the Website, including, without limitation, the particulars of each sale provided on the Website.

When you have completely reviewed your order, check the box next to “I accept” to indicate your agreement to be bound by these Conditions of Sale, and then click on the “Confirm and place order” button on the Website to place your order.

By placing an order, you are submitting an offer to the Fondation Cartier to purchase the products placed in your “Shopping Bag”. Notwithstanding anything to the contrary provided for herein, the Fondation Cartier reserves the right to refuse, cancel and terminate orders at any moment in time.

8. Payment

8.1. 
You can pay for your order by either credit or debit card as indicated on the Website.

When ordering on the Website, you will need to enter your payment details on the appropriate form. For more information about how we use and protect your information, please view our Privacy Policy.

All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to the Fondation Cartier, you will need to contact your card issuer directly to solve this problem, and the Fondation Cartier will not be held liable for any delay or non-shipment.

In order to process your order, we may perform a pre-authorization of your payment card. The amount of your purchase will be blocked on your payment card until your order is shipped to the shipping address you have provided to the Fondation Cartier, at which time you will be sent an Order Confirmation and your payment card will be charged the applicable purchase price. By submitting an offer to purchase products on the Website, you expressly authorize the Fondation Cartier to perform such payment card pre-authorization and, where the Fondation Cartier deems necessary, to transmit or to obtain information (including any updated information) about you to or from third parties from time to time, including but not limited to your payment card number, to authenticate your identity, to validate your payment card to obtain an initial payment card authorization and to authorize individual purchase transactions. In accordance with this contract, payment processing services for products purchased on this website by credit or payment card are provided by Cartier SNC, a general partnership registered with the Paris Commercial Register of Companies under the number B331 876 284, having its headquarters at 261 boulevard Raspail, Paris, 75014.

8.2. Security
The Fondation Cartier takes precautions—including administrative, technical and physical measures—to safeguard your personal information against loss, theft and misuse as well as against unauthorized access, disclosure, alteration and destruction. The Fondation Cartier uses “Secure Sockets Layer” (SSL) encryption on all web pages where personal information is collected.

Although we will do our best to protect your personal information, we cannot guarantee the security of the data you transmit to the Website, nor be held responsible for any loss or damage as a result of Internet use, such as hacking for example. In order to secure your transaction and prevent fraud, the Fondation Cartier will perform a credit card and anti-fraud check. By placing your order, you will be deemed to have authorized the Fondation Cartier to perform such checks and, where Cartier deems necessary, from time to time to transmit or obtain information that you have provided to Cartier about you in order to authenticate your identity, to validate your credit card, to obtain an initial credit card authorization and to authorize a particular purchase transaction.

9. Acknowledgment of Order

Once you have placed your order on the Website, you will receive an Acknowledgement of Order by email acknowledging the details of your order, as well as the present Conditions of Sale. This Acknowledgment of Order will contain an Order Reference Number assigned by the Fondation Cartier. Please carefully read the Conditions of Sale and make sure that you save the Order Reference Number for any future enquiries regarding your order.

This Acknowledgment of Order is not an acceptance of your order. Following the transmission of the Acknowledgment of Order, the Fondation Cartier will conduct its usual security and anti-fraud checks and then process your order.

10. Confirmation of Order by the Fondation Cartier

Upon shipment of your order, following completion by the Fondation Cartier of its anti-fraud and security checks, the Fondation Cartier will send you by email a written Order Confirmation.

The Order Confirmation constitutes the acceptance of your order by the Fondation Cartier and indicates the existence of a binding sales contract.

The Fondation Cartier will save information concerning all orders in accordance with applicable law. These documents will be made available to Customers after signing into the “My Account” section of the Website.

11. Shipping Policy

Shipping costs will be assessed by the Fondation Cartier and will be added to the price of the products ordered. Please refer to the Website for additional information.

Shipping costs and estimated shipping lead times will be indicated on the Website and summarized in the Acknowledgment of Order.

When estimating package shipping time, please allow time for credit approval, address verification and order processing. Once the order is processed and ready for shipment, we will send you the Order Confirmation by email.

We will make reasonable efforts to ensure estimated shipping lead times are met from the date of your order.

12. Invoicing

When ordering products on the Website, you, as the Customer, will have the option to choose whether you wish to receive an invoice at your billing address by regular mail. If you decide at this moment that you do not want to receive an invoice, you may at any time view your invoice by signing into the “My Account” section of the Website.

13. Return Policy

As a Customer, you have the right to return your purchase within 14 days without justification. The time period for returning a purchase ends after 14 days from when you or a third party indicated by you receives the merchandise.

To return your purchase, you must clearly state your intention to do so by notifying us in writing (a mailed letter or email for example).

If you decide to return your purchase within the 14-day return period, we will fully reimburse all payments made, including shipping costs (apart from any additional costs resulting from your choice of a shipping option other than the cheapest standard shipping option offered by the Fondation Cartier), in the shortest time possible.

We will reimburse you using the same payment method that you used for the initial transaction.

You must return or ship the merchandise as soon as possible and no later than 14 days after you have notified us of your intention to return your purchase. The return period is complied with if you return the merchandise before the end of the 14-day time period.

The Customer will not be reimbursed if the value of the product has decreased due to wear and tear caused by any use exceeding the limits necessary for determining the type, features and proper functioning of the product.

14. Return Process

14.1. Return Process
Products that have been bought on the Website may be returned at the following address: SNC Cartier 261 boulevard Raspail, Paris, 75014.
Upon receiving a return, the Fondation Cartier will verify that the returned product satisfies these Conditions of Sale.

14.2. Conditions to Return a Product
Cartier products must be returned in a new and unused state.
If the returned product satisfies Quality Control (QC), the Fondation Cartier will proceed with the applicable refund.
Please note that the costs of returning a product are to be paid entirely by the Customer.

15. Warranty

As a Customer, you have the same rights under applicable domestic laws governing the sale of consumer goods; these rights are not affected by these Conditions of Sale.

16. Accuracy of Pricing, Product Descriptions

While the Fondation Cartier endeavors to verify the accuracy of any information it places on the Website, it makes no warranties, whether express or implied, in relation to the accuracy, reliability and completeness of such information. The Fondation Cartier does not confirm the price of a product until an Order Confirmation has been issued by Cartier, indicating the existence of a binding sales contract.

While every effort will be made to ensure that the descriptions, photographs or graphical representations of the products displayed on the Website are as accurate as possible, the Fondation Cartier does not warrant that such materials or other contents are error-free, whether as a result of inaccuracy, omission, obsolescence or otherwise. Accordingly, the Customer’s sole remedy in the event of any such error is to return the product as set forth in our Return Policy.

17. Final Clauses

Information and claims.

Entire Agreement.
The Conditions of Sale (as amended from time to time), including policies incorporated herein (e.g., Privacy Policy) constitute the entire agreement between you and the Fondation Cartier regarding your purchase of products on the Website, and supersede any prior Conditions of Sale.

Severability.
In the event that one of the Conditions of Sale is considered, for whatever reason, partially void or unenforceable by a court of law, it shall be void or unenforceable only to this extent, and the validity and applicability of the other Conditions of Sale shall not be affected.

18. Governing Law

These Conditions of Sale are governed and construed in accordance with French Law without reference to provisions regarding a possible conflict of laws and with the exception of the Convention on the International Sale of Goods (CISG).

19. Courts Having Jurisdiction

You can initiate proceedings against the Fondation Cartier in either a French court or in the country in which you live. Cartier can also initiate proceedings against you in the country in which you live.
Without restricting the ability to initiate proceedings in a court of law, the Fondation Cartier or the Customer shall make every possible effort for a period of thirty (30) days to amicably settle any legal claim or dispute that may be due or linked to a product, the Conditions of Sale or any related controversy.
